Assistant Attorney General William Varga said in a "advisory letter" Monday, that the $25. levied on every homeowner and the $150. on businesses in the City is a "tax" and not a "fee" because it is a general charge for property owners, whether they have a sidewalk in front of their home or place of business or not. He went on to say according to an interview in tonight's evening
Capital that "in order for a charge to be a regulatory fee, there must be a sufficient nexus between the charge imposed and the cost of services provided to the property assessed."
Perhaps not as legally tongued, nor with as many big words, but almost exactly the same thing your host blogger said repeatedly when this issue first arose in Mid June.

Not a stretch that the City would do something illegal.
